No objection certificate

Also called: NOC

A letter from a person, body or authority stating that it has no objection to a particular act, such as a sale, a transfer, a loan closure or a change of job.

A no objection certificate (NOC) is a short letter by which someone with an interest says they do not object to what you plan to do. There is no single law for NOCs; the need for one comes from the rules of the body involved or from a specific law.

Common NOCs

  • From a bank, after a loan is repaid, confirming no dues and releasing its charge on a property or vehicle.
  • From a housing society, before a flat is sold or let.
  • From legal heirs, when one heir deals with a property or claim.
  • From an employer, for higher studies, a passport or another job.
  • From authorities, for building, fire safety or pollution clearances under their own laws.

Loan NOCs and original documents

RBI's rules require banks and other regulated lenders to return original movable and immovable property documents within 30 days after full repayment or settlement of a personal loan, and to pay compensation for each day of delay caused by them. Ask for the NOC and the originals together.

Be specific

An NOC should name the person, the property or matter, and the exact purpose. A vague NOC may not be accepted by the Sub-Registrar or another office.

Draft a general NOC, a society NOC for sale, a bank loan NOC request or an NOC from legal heirs.
