APPRENTICESHIP AGREEMENT This AGREEMENT is made on [effective_date] between [establishment_name], of [establishment_address] (the "Establishment"), and [apprentice_name], son/daughter of [apprentice_father_name], residing at [apprentice_address] (the "Apprentice"). 1. ENGAGEMENT The Establishment engages the Apprentice to undergo apprenticeship training in the trade of [trade], in accordance with the Apprentices Act, 1961 and the rules made under it. 2. PERIOD OF TRAINING The apprenticeship shall commence on [start_date] and continue for [duration_months] months. 3. TRAINING PROGRAMME [training_details] The Establishment shall impart training in accordance with the programme prescribed for the trade, provide adequate instructional staff and facilities, and maintain a record of the training imparted. 4. STIPEND 4.1 The Establishment shall pay the Apprentice a monthly stipend of Rs. [monthly_stipend], payable by the tenth day of the following month. 4.2 The stipend shall not be less than the minimum rate prescribed under the Apprentices Act, 1961 and the rules made under it for the category and year of training. 4.3 The stipend is not wages, and the Apprentice is not entitled to any allowance, bonus or benefit payable to employees. 5. STATUS OF THE APPRENTICE 5.1 The Apprentice is a TRAINEE and NOT a worker or employee of the Establishment. Under Section 18 of the Apprentices Act, 1961, the provisions of labour law relating to workmen do not apply to an apprentice, save as expressly provided. 5.2 Nothing in this Agreement entitles the Apprentice to claim employment with the Establishment on completion of training, and the Establishment is under no obligation to offer employment. 6. OBLIGATIONS OF THE APPRENTICE The Apprentice shall: learn the trade conscientiously and diligently; attend regularly and punctually; carry out lawful instructions; observe the Establishment's rules, safety instructions and working hours; maintain confidentiality of the Establishment's information; and appear for the prescribed tests and examinations. 7. LEAVE The Apprentice shall be entitled to leave in accordance with the rules made under the Apprentices Act, 1961. 8. HEALTH AND SAFETY The Establishment shall provide a safe working environment, necessary safety equipment, and instruction in safe working practices, and shall comply with the provisions relating to the health, safety and welfare of apprentices. 9. TERMINATION 9.1 This Agreement terminates automatically on completion of the training period. 9.2 It may be terminated earlier by mutual agreement, or by the Establishment for serious misconduct or persistent absence, subject to the procedure prescribed under the Act. 9.3 Any dispute arising out of this Agreement shall be referred to the Apprenticeship Adviser in accordance with Section 20 of the Apprentices Act, 1961. 10. CERTIFICATE On satisfactory completion of the training and on passing the prescribed test, the Apprentice shall be issued a certificate of proficiency in accordance with the Act.
