దీని వెనుక ఉన్న చట్టం

Leases are governed by the Transfer of Property Act, 1882. Under section 17(1)(d) of the Registration Act, 1908, a lease from year to year or for more than one year must be registered, which is why eleven month agreements are common. Some states, such as Maharashtra, require registration of all leave and licence agreements whatever their length. Stamp duty is set by each state, and an understamped document is not admissible in evidence until duty and penalty are paid. State rent control laws, and the Model Tenancy Act where adopted, may also apply.

నివారించడానికి సాధారణ తప్పులు

  • Using stamp paper of the wrong value or wrong state, which can make the agreement inadmissible until penalty is paid.
  • Signing a term longer than one year, or any term your state requires to be registered, without registering it, so it cannot be relied on as a lease in court.
  • Not listing fixtures and their condition, leading to disputes over deductions from the security deposit.

అద్దె ఒప్పందం: తరచుగా అడిగే ప్రశ్నలు

Why are rent agreements usually made for 11 months?

Under the Registration Act, 1908, a lease for more than one year must be registered, which involves a visit to the Sub-Registrar and higher stamp duty in many states. An eleven month agreement avoids compulsory registration under that Act. Some states, such as Maharashtra, require registration whatever the length.

What is the stamp duty on a rent agreement?

Stamp duty is fixed by each state and depends on the term, rent and deposit. Some states charge a flat amount for short agreements and a percentage of rent for longer ones. Check the current rate with the local stamp office or Sub-Registrar before buying stamp paper.

Is notarisation of a rent agreement enough?

Notarisation only confirms the identity of the signatories. It does not replace stamp duty or registration. A properly stamped eleven month agreement signed before witnesses is commonly used, and where registration is required, notarisation alone does not satisfy the law.

Can the landlord keep the security deposit?

Under this agreement the landlord must refund the deposit within 30 days after the tenant vacates and hands over possession, after deducting unpaid rent, utility dues and the cost of damage beyond normal wear and tear. Deductions should be explained in writing, ideally with photographs taken at move in and move out.

What happens if a rent agreement that should have been registered is not registered?

Under section 49 of the Registration Act, 1908, a document that section 17 requires to be registered does not affect the property and cannot be received as evidence of the transaction unless it is registered. The proviso to section 49 still allows an unregistered document to be used as evidence of a contract in a suit for specific performance, or as evidence of a collateral transaction that does not itself need registration. Some States have their own registration rules for tenancies, so check the State law as well.

Who pays the stamp duty on a rent agreement, landlord or tenant?

The parties can agree either way. Where the Indian Stamp Act, 1899 applies, section 29(c) says that unless there is an agreement to the contrary the lessee (tenant) bears the cost of the stamp on a lease or agreement to lease, and section 29(d) puts the stamp on any counterpart on the lessor. Several States have their own stamp laws, so the rule and the rate depend on the State where the agreement is signed. Writing down who pays avoids disputes.

Does the Model Tenancy Act, 2021 apply to my rent agreement?

Not automatically. The Union Cabinet approved the Model Tenancy Act in June 2021 for circulation to the States and Union Territories, to be adopted by enacting fresh legislation or by amending their existing rental laws. It applies in a State only to the extent that State has passed its own law based on it. Check the rent or tenancy law of the State where the property is situated.
