A COMPLETION CERTIFICATE (CC) certifies that the building has been constructed in accordance with the sanctioned plan. An OCCUPANCY CERTIFICATE (OC) certifies that the building is fit to be occupied — that services are connected, safety requirements met, and the necessary clearances obtained. IT IS THE OC THAT PERMITS LAWFUL OCCUPATION. Occupying a building without one is an offence in most States, and it has practical consequences that surface at the worst time: - Banks may refuse a home loan on a property without an OC, which shrinks the pool of buyers when you sell. - Water, electricity and sewerage connections may be refused or given only on a temporary basis. - The municipality can levy penal property tax, and in some States can act against the occupation itself. - A buyer's advocate will ask for it, and its absence will either kill the sale or knock the price down. IF YOU ARE BUYING a flat or a house, ask for the OC and read it — do not accept "it is applied for". A builder who has deviated from the sanctioned plan cannot get one, and that is usually why it is missing. DEVIATIONS: declare them rather than hoping they go unnoticed. Minor deviations are often compoundable on payment of a fee; concealed ones found at inspection are treated far less kindly, and the certificate is withheld until they are regularised or removed.
