DRAFTING NOTES
1. REGISTRATION. Under section 17 of the Registration Act, 1908, a non-testamentary instrument that itself creates, declares, assigns, limits or extinguishes rights in immovable property worth Rs. 100 or more must be registered. A deed that itself divides land, a house or a flat among family members therefore usually needs registration with the Sub-Registrar. Courts have held that a memorandum merely recording a family arrangement already made orally may not need registration, but this turns on the exact wording. An unregistered deed that required registration cannot be relied on as proof of title. Take an advocate's advice on this before signing.
2. STAMP DUTY. Stamp duty is fixed by each State, and several States charge a concessional rate for settlements among family members. Check the current rate with your State's stamp or registration department and execute the deed on stamp paper or with an e-stamp certificate where duty is payable.
3. WHO SIGNS. Every family member who holds or claims a share in the assets should be a party and should sign. Leaving out a person with a share, such as a married daughter, exposes the settlement to challenge. A minor's interest needs proper representation, and in some cases court permission is needed before a minor's immovable property can be dealt with.
4. DESCRIBE THE ASSETS PRECISELY. Give survey, khasra or plot numbers, boundaries, flat numbers, and account or folio numbers, so that mutation and transfers are not held up.
5. Add or strike out signature lines so that they match the number of parties.
A Family Settlement Deed records how members of a family have agreed to divide assets they hold jointly or claim together, so that each person knows what is theirs and no one goes to court later. It records a voluntary, full and final settlement signed by every family member who is a party to it.
- Siblings have inherited a house, land or business together and want to divide it without a partition suit.
- A family dispute over ancestral property has been resolved through talks and the terms need to be put on paper.
- One branch of the family is moving away and wants its share separated and recorded.
- A bank, society or revenue office asks for a written record of how family property was divided before it will change its records.
- The date of execution and the names of all family members who are parties.
- A description of the assets being divided.
- The agreed division, stating which member takes which asset or share.
- A full and final settlement clause under which no party will raise a claim inconsistent with the deed.
- A confirmation that the settlement is voluntary and free from coercion, followed by the signatures of all members.
- List every family member who has or may claim a share, and every asset to be divided, with full property descriptions, survey or plot numbers and account details.
- Agree the division in discussion and enter the names, assets and terms in the form, then check every detail in the preview.
- Get it reviewed by an advocate before signing, because whether this deed must be stamped and registered depends on its wording and on your state, and getting that wrong can make it unusable as proof of title.
- Pay the stamp duty that applies in your state and print the deed on stamp paper or with an e-stamp certificate, where required.
- Have every party sign before two witnesses, and register it with the Sub-Registrar where registration is needed.
- Use the signed or registered deed to apply for mutation in revenue or municipal records, and to transfer bank accounts, shares or vehicles.
- Give each party a copy and keep the original safe.
- Title documents and earlier sale, gift or inheritance papers for each property.
- Death certificate and legal heir or succession documents, where the assets came through inheritance.
- Identity and address proof of all parties.
- Latest property tax receipts, revenue extracts or encumbrance certificates.
- A site plan or map, where land or a building is being divided.
A family settlement is a contract among family members, and courts in India have long favoured such settlements where they are bona fide, voluntary and made among persons with a claim to the property. Whether the deed needs registration under the Registration Act, 1908 depends on its wording: courts have held that a memorandum recording a settlement already made orally may not need registration, while a deed that itself divides immovable property usually does. Stamp duty is set by each state, and several states charge a concessional rate for family settlements.
- Leaving out a family member who has a share, such as a married daughter, which can make the settlement open to challenge.
- Describing land or flats loosely, without survey numbers, boundaries or flat numbers, which causes trouble at mutation.
- Signing an unregistered deed that itself transfers immovable property, which may not be accepted as proof of title.
- Including a minor's share without proper representation, which can later be questioned.
Is registration of a family settlement deed compulsory?
It depends on the wording. Where the deed itself divides rights in immovable property, registration is usually needed. Where it only records a settlement already made orally, courts have sometimes held that it is not. Take advice before relying on an unregistered deed.
How much stamp duty is payable on a family settlement deed?
Stamp duty is fixed by each state, and many states charge a lower rate for settlements among family members than for a sale. The amount can depend on the value of the property and the relationship between the parties. Check the current rate with your state's stamp or registration department.
Can a family settlement be challenged later?
A settlement that was voluntary, fair and signed by all members with an interest is difficult to set aside. Challenges usually succeed only on grounds such as fraud, coercion, or a member being left out. Keeping a clear record of who agreed and why helps protect it.
Who should sign a family settlement deed?
Every family member who holds or claims a share in the assets being divided should sign. If anyone is a minor, they need proper representation, and court permission may be required for dealing with a minor's immovable property in some cases. Two witnesses should also sign.
Is an oral family settlement valid?
Yes. In Kale v. Deputy Director of Consolidation (1976), the Supreme Court held that a family arrangement may even be oral, and in that case no registration is necessary. The Court also said the arrangement must be bona fide, made to resolve family disputes by a fair and equitable division, and voluntary, not induced by fraud, coercion or undue influence. Because an oral arrangement leaves no document, families often record it afterwards in a written memorandum, which the Court treated differently from a deed that itself divides the property.
Can a relative who is not a legal heir be a party to a family settlement?
Yes, in many cases. In Kale v. Deputy Director of Consolidation (1976), the Supreme Court said the term family is to be understood in a wider sense, covering not only close relations or legal heirs but also persons who have some antecedent title, a semblance of a claim, or even a hope of succession. The parties must have some antecedent title, claim or interest, even a possible claim, that the settlement acknowledges. Where one party has no title but the others relinquish their claims in that person's favour, the court will assume the antecedent title and uphold the arrangement.
Can an unregistered family settlement still be relied on?
It can still have some use. In Kale v. Deputy Director of Consolidation (1976), the Supreme Court held that even an unregistered family arrangement could be used for a collateral purpose, such as showing the nature and character of each party's possession under it. The Court also applied the rule of estoppel against parties who took the benefit of the settlement for years and then tried to go back on it. These uses do not replace registration where the deed itself is required to be registered.
