അതിന് പിന്നിലെ നിയമം

Under the Consumer Protection Act, 2019, a deficiency means any fault, imperfection, shortcoming or inadequacy in the quality, nature or manner of performance of a service, including negligence and deliberate withholding of relevant information. Services given free of charge or under a contract of personal service are excluded. The complaint is filed before the District, State or National Commission according to the value paid, within two years of the cause of action. An appeal from a District Commission's order lies to the State Commission within 45 days.

ഒഴിവാക്കേണ്ട സാധാരണ തെറ്റുകൾ

  • Filing in a Commission without pecuniary or territorial jurisdiction, so the complaint is returned.
  • Filing after two years without an application explaining the delay.
  • Describing the problem vaguely, with no dates, amounts or documents showing what was promised.
  • Claiming compensation figures with no basis, or leaving costs and interest out of the relief.

What counts as deficiency in service under consumer law?

Any shortfall in the quality, nature or manner of a service you paid for, compared with what the law requires or what was promised. Delays, non-delivery, overcharging, poor workmanship and negligence can all qualify. Services given free, or under an employment-type contract of personal service, are not covered.

Can I file a consumer complaint without a lawyer?

Yes. A consumer can draft, file and argue the complaint in person, and online filing through e-Daakhil makes this easier. Where both sides agree, the Commission can also refer the dispute to mediation. For high-value or complicated cases, many people still choose to engage an advocate.

Is a legal notice compulsory before filing a consumer complaint?

No. The Consumer Protection Act, 2019 does not require a notice before filing. Sending one is still useful, because it gives the service provider a final chance to settle and shows the Commission that you tried to resolve the matter first.

How long does a consumer case take?

The Act aims for a complaint to be decided within three months of notice to the opposite party, or five months where goods need laboratory testing. In practice, many cases take longer, depending on the Commission's workload and adjournments. Keeping your documents complete and attending every date helps avoid delay.

What is the fee for filing a consumer complaint?

The fee is set by rule 7(2) of the Consumer Protection (Consumer Disputes Redressal Commissions) Rules, 2020, as amended in August 2023, and depends on the value of the goods or services paid as consideration, not on the compensation claimed. No fee is payable up to Rs 5 lakh. Above that it is Rs 200 up to Rs 10 lakh, Rs 400 up to Rs 20 lakh, Rs 1,000 up to Rs 50 lakh, Rs 2,000 up to Rs 1 crore and Rs 2,500 up to Rs 2 crore, with higher slabs for larger amounts before the National Commission.

What happens if the District Commission does not decide whether to admit my complaint?

Under section 36(2) of the Consumer Protection Act, 2019, the District Commission should ordinarily decide whether to admit a complaint within 21 days of filing, and it cannot reject the complaint without giving the complainant a hearing. If it does not decide admissibility within that period, section 36(3) says the complaint is deemed to have been admitted.

How long does the service provider get to reply to my complaint?

For a complaint about services, section 38(3)(a) of the Consumer Protection Act, 2019 directs the opposite party to give its version within 30 days, or within an extended period of not more than 15 days granted by the Commission. If it fails to respond in time, section 38(3)(b)(ii) allows the Commission to decide the complaint ex parte on the complainant's evidence. In New India Assurance v. Hilli Multipurpose Cold Storage (2020), a Constitution Bench held under the identically worded provision of the 1986 Act that the Commission has no power to extend time beyond these 45 days.
