पुलिस शिकायत पत्र: यह क्या है

A police complaint letter is a written complaint addressed to the Station House Officer of a police station describing an incident and asking for action. It gives the police a dated record of what happened, who you are and what you want done, and it is often the first step towards registration of an FIR.

जब आपको इस दस्तावेज़ की आवश्यकता होती है

  • Someone has stolen your belongings, damaged your property or assaulted you and you want the police to act.
  • You are being harassed or threatened by a neighbour, acquaintance or stranger.
  • A shopkeeper, contractor or agent has cheated you of money and you want it on record with the police.
  • The police asked you to give your complaint in writing after you reported an incident verbally or by phone.

इसमें क्या शामिल है

  • Your name, address and phone number.
  • The police station the complaint is addressed to, through its Station House Officer.
  • The date of the incident in the subject line.
  • A free text account of the incident in your own words.
  • The specific action you want the police to take.
  • A statement that you are available for further information, followed by your signature and date.

इसे कैसे भरें, हस्ताक्षर करें और उपयोग करें

  1. Write out the incident in date order before drafting: what happened, where, when, who was involved and who saw it.
  2. Fill in the form on this page and check the preview, making sure names, places and times are accurate.
  3. Print two copies and sign both.
  4. Submit the complaint at the police station that has jurisdiction over the place of the incident and ask for a stamped receipt on your copy, or the FIR number if an FIR is registered.
  5. If the station refuses to act on a cognizable offence, send the complaint by post to the Superintendent of Police and keep the postal receipt.
  6. Keep your receipt, copies and any FIR copy for follow up and for any later court proceeding.

संलग्न करने या रखने के लिए दस्तावेज़

  • Photographs or videos of the incident, injury or damage.
  • Medical report, if you were injured.
  • Copies of messages, bills, receipts or other papers connected to the incident.
  • Names and contact details of witnesses.

इसके पीछे का कानून

Police complaints are governed by the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), which replaced the Code of Criminal Procedure from 1 July 2024. For a cognizable offence, the police must record information as an FIR under section 173 BNSS; zero FIR and e-FIR are recognised, and you are entitled to a free copy. If the station refuses, you can write to the Superintendent of Police under section 173(4), and then approach the Magistrate under section 175(3) or file a complaint under section 223. Non-cognizable complaints are entered in a register and referred to the Magistrate.

बचने के लिए आम गलतियाँ

  • Writing a vague account without dates, times, places or names, which makes it hard for the police to register a case.
  • Leaving the station without a receipt, a diary number or an FIR copy.
  • Adding allegations you cannot support, which can weaken the genuine parts of the complaint.
  • Waiting a long time before complaining without explaining the delay, which can be used against you later.

पुलिस शिकायत पत्र: अक्सर पूछे जाने वाले प्रश्न

What is the difference between a police complaint and an FIR?

A complaint is the information you give the police. When it reveals a cognizable offence, such as theft, grievous hurt, or cheating that dishonestly induces delivery of property, the police record it as a First Information Report, which formally starts the investigation. If the offence is non-cognizable, the police enter it in a register and you may be directed to approach the Magistrate instead.

Can I file a police complaint at any police station?

Yes, for cognizable offences. Under the zero FIR rule, any police station must register the FIR even if the incident happened elsewhere, and then transfer it to the police station with jurisdiction. In practice, filing at the station covering the place of the incident usually leads to faster action.

What should I do if the police refuse to register my complaint?

Send the substance of your complaint in writing to the Superintendent of Police by post, which is the mode section 173(4) BNSS provides, and keep the postal receipt. If that also fails, you can apply to the Judicial Magistrate under section 175(3) BNSS for a direction to investigate, or file a private complaint under section 223 BNSS.

Can I file a police complaint online?

Most state police departments have citizen portals where you can file complaints, and many accept e-FIRs for certain offences such as theft of property. Under the BNSS, an e-FIR must be signed by the informant within three days for it to be taken on record. For cyber crime, use the national cybercrime portal.

Will the police tell me how the investigation of my complaint is going?

Yes. Section 193(3)(ii) of the Bharatiya Nagarik Suraksha Sanhita, 2023 requires the police officer to inform the informant or the victim of the progress of the investigation within ninety days, by any means including electronic communication. Section 193(3)(iii) also requires the officer to communicate the action taken to the person who first gave the information, in the manner set by State rules. Keep your FIR number and contact details with the station so the update can reach you.

Is there a time limit for filing a police complaint?

Offences punishable with more than three years' imprisonment have no limitation period under the BNSS. For lesser offences, section 514 BNSS bars a court from taking cognizance after six months if the offence is punishable with fine only, one year if punishable with imprisonment up to one year, and three years if punishable with imprisonment above one year up to three years. Under section 515 the period runs from the date of the offence, or from the day it first became known to you or the police, and under the Explanation to section 514 it is counted up to the date the police record the information under section 173 or a complaint is filed before the Magistrate under section 223. Section 519 lets a court proceed after the limit if the delay is properly explained or it is needed in the interests of justice, so explaining any delay in the complaint itself is useful.

What happens if someone files a false police complaint?

Giving a public servant information you know or believe to be false, intending the police to use their powers to harm or annoy someone, is punishable under section 217 of the Bharatiya Nyaya Sanhita, 2023 with up to one year's imprisonment, a fine up to Rs 10,000, or both. Starting criminal proceedings against a person, or falsely charging a person with an offence, with intent to injure that person and knowing there is no just or lawful ground, is punishable under section 248 BNS with up to five years' imprisonment, a fine up to Rs 2 lakh, or both. Where the false charge is of an offence punishable with death, life imprisonment or ten years or more, the punishment can extend to ten years, with fine. State only what you know, and say which details you heard from others.
