DRAFTING NOTES
An application for anticipatory bail lies to the Court of Session or the High Court. Certain offences and certain special statutes restrict or exclude anticipatory bail altogether, so check the position for every section in the FIR before filing.
Paragraph 4.3: state every previous conviction and every pending criminal case, or write "None". Paragraph 5: state every earlier anticipatory bail application in this matter (for example one rejected by the Sessions Court before you approach the High Court), or write "None". Courts treat suppression of either as serious, and it can lead to rejection or later cancellation of bail.
Courts commonly require the application to be supported by an affidavit of the applicant. Ask your advocate about the practice of the court where you are filing.
This is a drafting template only. Representation by an advocate is strongly recommended.
An anticipatory bail application asks a Sessions Court or High Court to direct that, if you are arrested in a particular case, you will be released on bail. It is filed under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by someone who reasonably fears arrest for a non-bailable offence, either after an FIR is registered or when one is threatened.
- An FIR has been registered against you for a non-bailable offence and you fear the police will arrest you.
- A family dispute has led to a complaint against you and other relatives, and arrest is being threatened.
- A business partner or former employer has accused you of cheating or breach of trust in a police complaint.
- You have received a notice or information that the police are looking for you in connection with a case.
- The court, the FIR number, police station and sections alleged, with your name, relation and address.
- Your reasons for apprehending arrest for a non-bailable offence, stated as real and immediate.
- The facts of the case and your own version.
- Grounds such as false implication, roots in society, no need for custodial interrogation and willingness to join the investigation, with a disclosure of any previous conviction or pending criminal case.
- Undertakings not to tamper with evidence or influence witnesses and not to leave India without permission, and details of any earlier anticipatory bail application in the matter.
- A prayer that you be released on bail in the event of arrest, signed by you through your advocate.
- Collect the FIR copy, any police notice, and documents that support your version.
- Fill in the form on this page and check that the FIR number, police station and sections match the FIR exactly.
- Have an advocate review and finalise the draft before filing, because the grounds, the choice of court and any statutory bar on anticipatory bail need legal judgment in each case.
- Sign the application and the supporting affidavit, which is usually sworn before an oath commissioner at the court.
- File it in the Sessions Court or High Court with the FIR copy, vakalatnama and annexures, and serve a copy on the public prosecutor.
- Attend the hearing; if interim protection is granted, follow every condition and join the investigation when called.
- Keep a certified copy of the order and give a copy to the investigating officer.
- Copy of the FIR or complaint.
- Any notice received from the police.
- Documents supporting your version, such as agreements, messages or bank records.
- Identity and address proof.
- Vakalatnama in favour of your advocate.
Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly section 438 CrPC) allows a person who fears arrest for a non-bailable offence to apply to the Court of Session or the High Court. The court may impose conditions, such as making yourself available for questioning, not threatening witnesses and not leaving India without permission. Anticipatory bail is not available for certain serious sexual offences against young girls, and some special laws, such as the SC/ST (Prevention of Atrocities) Act, restrict it. The Supreme Court has held that protection need not be limited to a fixed period. Section 531 of the BNSS keeps the old Code in force for any application or investigation pending on 1 July 2024. High Courts have differed on whether an anticipatory bail application filed after that date in a case registered earlier falls under section 438 CrPC or section 482 BNSS.
- Hiding an earlier anticipatory bail application on the same FIR, which courts treat as serious suppression.
- Copying sections wrongly or leaving out an offence listed in the FIR.
- Ignoring police notices to join the investigation, which can lead to cancellation of bail.
Where do I file anticipatory bail, Sessions Court or High Court?
Both courts have power under section 482 BNSS. In practice, most applicants first approach the Sessions Court of the district where the FIR is registered. If it is rejected, an application can be made to the High Court.
Can I get anticipatory bail before an FIR is registered?
Yes, if you can show a reasonable and specific apprehension of arrest for a non-bailable offence, for example a complaint already given to the police or a clear threat of a false case. A vague fear is not enough. The court will look at the material you place before it to judge whether the fear is genuine.
How long is anticipatory bail valid?
The Supreme Court has held that anticipatory bail need not be limited to a fixed period and can continue till the end of the trial, unless the court that grants it sets a time limit or specific conditions. Breaking its conditions can lead to cancellation.
Can the police arrest me after anticipatory bail is granted?
If you are arrested in the case covered by the order, the police must release you on bail on the terms the court set, usually on furnishing a bond. You must still join the investigation when asked. The protection covers only the FIR named in the order, not other cases.
Can I get anticipatory bail if a proclamation has been issued against me?
Usually not. In Srikant Upadhyay v State of Bihar (2024) the Supreme Court reiterated that a person against whom a warrant has been issued, who is absconding or concealing himself to avoid it, and who has been declared a proclaimed offender, is normally not entitled to anticipatory bail. A proclamation is issued under section 84 of the BNSS (formerly section 82 CrPC) when a court believes the person is absconding. The Court added that this does not take away the power to grant pre-arrest bail in extreme, exceptional cases, and it looked at the applicants' conduct after the warrant was issued.
Is anticipatory bail available in a case under the SC/ST (Prevention of Atrocities) Act?
Sections 18 and 18A of the SC/ST (Prevention of Atrocities) Act, 1989 say the anticipatory bail provision does not apply to cases under that Act. In Prathvi Raj Chauhan v Union of India (2020), the Supreme Court upheld section 18A but held that if the complaint does not make out a prima facie case under the Act, the bar does not apply. The Court added that this power is to be used sparingly, in exceptional cases.
