DRAFTING NOTES

A release works only in favour of a person who is already a co-owner or co-heir of the same property. Recital A must show how both parties came to hold it, for example by inheritance from a named person and the date of death. If the person receiving the share is not a co-owner, the correct document is usually a gift deed or a sale deed.

Registration is compulsory. Under section 17 of the Registration Act, 1908, a non-testamentary document that extinguishes or assigns a right in immovable property worth Rs. 100 or more must be registered. An unregistered release cannot generally be relied on to prove title, and mutation is usually refused on it.

For the consideration, state the amount in Rs. and how it was or will be paid, or write "no monetary consideration" where the release is made out of natural love and affection. Stamp duty is charged under the State's stamp law; several States charge a lower rate for releases between close family members, so confirm the rate before buying stamp paper or an e-stamp.

Have an advocate check the deed before signing. A registered release is very hard to undo except on grounds such as fraud, coercion or undue influence.

ત્યાગ ખત: તે શું છે

A Relinquishment Deed, also called a release deed, is a document by which a co-owner or legal heir gives up their share in a jointly held or inherited property in favour of another co-owner. This version records the property, the share released, the consideration, if any, and the releasor's confirmation that they will have no further claim.

જ્યારે તમને આ દસ્તાવેજની જરૂર હોય

  • After a parent's death, siblings agree that the family house should vest in one of them, and the others give up their shares.
  • A married sister wants to release her share in ancestral property in favour of her brothers or mother.
  • Co-owners of a flat want the title to stand in one name to simplify a sale, loan or mutation.

તે શું આવરી લે છે

  • A recital that the releasor holds an undivided share as co-owner or legal heir and has agreed to release it.
  • A description of the property and of the share being released.
  • The release of all right, title, claim and interest in that share for a stated consideration, or as gratuitous.
  • A confirmation that the releasor will have no further right, title or claim over the released share.

તેને કેવી રીતે ભરવું, સહી કરવી અને તેનો ઉપયોગ કરવો

  1. Confirm the releasee is already a co-owner or co-heir of the same property, since a release to an outsider is treated as a sale or gift.
  2. Collect title documents, the death certificate and heirship proof, and copy the property description exactly from the title deed.
  3. Fill in the form on this page with the parties, the property, the share and the consideration, and check the preview carefully.
  4. Have an advocate review it before signing, since the relationship and the property's history decide the stamp duty rate, and a badly framed release can be treated as a conveyance.
  5. Pay the stamp duty applicable in your State, either on stamp paper or through an e-stamp certificate, after confirming whether a family concession applies.
  6. Book an appointment and present the deed at the Sub-Registrar's office for registration, with both parties, two witnesses, photographs and identity proof.
  7. Collect the registered deed and apply for mutation in the municipal or revenue records in the releasee's name.

જોડવા અથવા તેની સાથે રાખવા માટેના દસ્તાવેજો

  • Title deed or document showing how the property was acquired.
  • Death certificate of the deceased owner and legal heir certificate or family tree, where the share is inherited.
  • Identity proof, address proof and photographs of the releasor, releasee and witnesses.

તેની પાછળનો કાયદો

A relinquishment deed transfers or extinguishes the releasor's interest in favour of another co-owner, and is governed by the Transfer of Property Act, 1882 and the general law of contract. Under the Registration Act, 1908, a non-testamentary document that extinguishes a right in immovable property of the value of Rs 100 or more must be registered, so a release of a share in immovable property generally needs registration. Stamp duty is charged under the State's stamp law and varies widely, with several States giving a lower rate for releases between close family members.

ટાળવા માટેની સામાન્ય ભૂલો

  • Executing the deed in favour of someone who is not a co-owner, which defeats its purpose and attracts sale or gift treatment.
  • Leaving it unregistered, so it cannot be relied on to prove title and the mutation is refused.
  • Signing under family pressure without understanding that a registered release is very hard to undo except on grounds such as fraud or coercion.

ત્યાગ ખત: વારંવાર પૂછાતા પ્રશ્નો

Is registration of a relinquishment deed compulsory?

Yes, where it relates to immovable property. A deed that extinguishes a right in immovable property worth Rs 100 or more must be registered under the Registration Act, 1908. An unregistered release cannot generally be used to prove the transfer, and municipal or revenue offices will usually refuse mutation on it.

How much stamp duty is payable on a relinquishment deed?

It depends on the State, the relationship between the parties and sometimes whether the property is ancestral. Many States charge a lower amount for releases among close family members and a higher rate otherwise. The state panel on this page shows verified figures for Karnataka and Maharashtra. For other States, check with the Sub-Registrar.

Can a relinquishment deed be cancelled after registration?

A validly executed and registered release is generally final. It can be challenged in court only on grounds such as fraud, coercion, undue influence or misrepresentation, and that requires evidence. The releasor cannot simply change their mind later, so it should be signed only after careful thought.

Can I relinquish my share in favour of a non-family member?

A release works only in favour of another co-owner of the same property. If you want to pass your share to someone who is not a co-owner, the correct document is usually a sale deed or a gift deed, which carry their own stamp duty and registration requirements.

Can I relinquish my property share by an affidavit instead of a deed?

An affidavit is not a substitute. A document that extinguishes a right in immovable property worth Rs 100 or more must be registered under section 17 of the Registration Act, 1908, and section 49 of that Act says an unregistered document of this kind does not affect the property and cannot be received as evidence of the transaction. An affidavit may support a mutation or bank file, but the release itself should be a registered relinquishment deed.

Can I relinquish my share in my father's property while he is alive?

Not in property your father owns himself. Section 6(a) of the Transfer of Property Act, 1882 says the chance of an heir apparent succeeding to an estate cannot be transferred, so a child has no share to release during the owner's lifetime. A relinquishment deed works for a share you already hold, such as after the owner's death or as a co-owner. Ancestral or joint family property raises different questions, so take advice.
