Legal notice

என்றும் அழைத்தார்: demand notice

A formal written notice, usually sent through an advocate, telling the other side of a claim and what they must do. It is compulsory before some cases, such as suits against the government and cheque bounce complaints.

A legal notice sets out the facts, the legal basis of the claim, and what the sender wants (payment, vacating a property, stopping an act), with a deadline. It often settles a dispute without a case, and where a case follows, it shows the court that the other side was told.

When a notice is compulsory

In most other disputes a notice is not legally required, but it is usual and sensible.

What to include

  • Names and addresses of both sides.
  • The facts in order, with dates and amounts.
  • The legal basis, and the documents you rely on.
  • What you want, the time allowed, and what you will do if it is not met.

Be careful

A notice you send can be used as evidence later. Keep it accurate and avoid statements you cannot prove.

Draft a legal notice or a consumer legal notice, and read how to reply to a legal notice.
