Details of employees, where applicable ──────────────────────────────────────────────────────────────── THIS IS MANDATORY, AND THE CLOCK HAS ALREADY STARTED Registration under the Shops and Establishments legislation of the State is COMPULSORY for virtually every commercial establishment — shops, offices, hotels, restaurants, warehouses, and in most States any premises where a business is carried on, including many home-run and online businesses with a commercial address. It is not optional, and it is not something to do "once the business picks up". MOST STATES REQUIRE APPLICATION WITHIN 30 DAYS of commencing business. Some allow 60. Operating without registration attracts a penalty, and in several States a continuing daily fine while the default persists. WHY IT MATTERS BEYOND THE PENALTY: - Banks generally require it to open a CURRENT ACCOUNT in the business name. This is the commonest reason people discover they need it. - Payment gateways and marketplaces ask for it during onboarding. - It is often required for a trade licence, a GST registration address proof, and for participating in tenders. - On an inspection, its absence invites scrutiny of everything else — wage registers, hours, leave records. RENEWAL: some States issue a certificate valid for life; others require periodic renewal. Diarise the expiry if yours renews, because lapsed registration is treated as no registration. ALSO NOTIFY CHANGES — a change of address, of business name, of ownership, or a closure — within the period prescribed. A closure not notified leaves an open registration and an open liability.
