PRESENTATION IN PERSON: Order XXXIII Rule 3 requires the application to be presented to the court by the applicant in person. If the court has exempted you from appearing, it may be presented by an authorised agent who can answer all material questions about the application. An application not framed and presented in the prescribed manner is liable to be rejected.

VERIFICATION AND AFFIDAVIT: Order XXXIII Rule 2 requires the application to be signed and verified like a pleading. Fill in the paragraph numbers in the verification, separating what you know personally from what you were told. Order VI Rule 15(4) requires an affidavit in support of a pleading, so prepare one unless the court's registry tells you otherwise.

THE SCHEDULE: list every item of movable and immovable property you own, with an estimated value, including bank balances, jewellery, vehicles and land. Understating or hiding property is a ground for rejection and can lead to costs.

THE FEE IS DEFERRED, NOT WAIVED: if permission is granted, the suit proceeds without the fee being paid upfront. If you win, the court fee is recovered under the decree as the court directs (Order XXXIII Rule 10). If you lose, or the permission is withdrawn, the court can order you to pay it to the State (Order XXXIII Rule 11).

INQUIRY: the court will give notice to the opposite party and the Government pleader and may take evidence on whether you are indigent before deciding. Free legal aid, including an advocate, is separately available from the District Legal Services Authority under the Legal Services Authorities Act, 1987.

An Application for Waiver of Court Fee, drafted here as an application under Order XXXIII of the Code of Civil Procedure, asks a civil court to let a person file a suit as an indigent person without first paying the court fee. The applicant explains their financial position, and if the court is satisfied, the suit proceeds without the fee being paid upfront.

  • You have a genuine civil claim, such as for property, maintenance arrears or money, but cannot afford the ad valorem court fee on the suit value.
  • A large claim would attract a court fee far beyond your means even though you have little income or property.
  • You have been advised to sue but need the court's permission before filing without paying the fee.
  • You wish to appeal as an indigent person after losing a suit, which follows a similar procedure for appeals.

  • The court, your details as proposed plaintiff with age, parentage, occupation and address, and the proposed defendant.
  • The particulars a plaint requires: facts and cause of action, jurisdiction, relief claimed, and the suit value with the court fee payable.
  • A statement that you lack sufficient means to pay the court fee, leaving out exempt property and the subject matter of the suit, with your financial circumstances.
  • Statements that you have not fraudulently disposed of property in the two months before applying and that no one else is financing the case.
  • A prayer for permission to sue as an indigent person without paying the court fee at this stage, and for the application to be treated as the plaint.
  • A schedule of all your movable and immovable property with estimated values, and a verification like a pleading.

  1. Prepare the full draft plaint for the intended suit, because the application must contain the particulars a plaint requires.
  2. Make an accurate schedule of all your movable and immovable property with estimated values, and attach it to the application.
  3. Fill in the form on this page, then expand the financial circumstances with specific details of income, dependants and assets.
  4. Have the application reviewed by an advocate before filing, because the law requires particular contents, verification and personal presentation, and a defective application can be rejected and affect your ability to file later.
  5. Sign and verify the application in the manner required for pleadings and present it in person to the court, unless the court exempts you.
  6. Attend the inquiry into your means, where the court may examine you and the other side and the government pleader may oppose. Keep copies of everything filed.

  • Draft plaint with all the particulars of the intended suit.
  • Schedule of movable and immovable property with estimated values.
  • Income proof or a statement that there is no regular income, such as salary slips, pension papers or a ration card.
  • Documents supporting the claim in the suit.
  • Identity and address proof.

Order XXXIII of the Code of Civil Procedure, 1908 allows a person to sue as an indigent person if they do not have sufficient means to pay the prescribed court fee, leaving out property exempt from attachment and the subject matter of the suit. The court holds an inquiry and can reject the application on grounds set out in the Order. The fee is deferred, not cancelled. If the suit fails, the court orders the plaintiff to pay it. If the suit succeeds, the State Government can recover it from whichever party the decree orders to pay it, and it is a first charge on the subject matter of the suit. Order XLIV applies similar rules to indigent appeals. Free legal aid is separately available under the Legal Services Authorities Act, 1987.

  • Filing only a bare application without the plaint particulars and the property schedule the Order requires.
  • Understating assets or hiding property, which can lead to rejection and costs if the other side proves it.
  • Transferring property shortly before applying in order to appear indigent, which is a recognised ground for rejection.
  • Assuming the fee is permanently waived, when it can become payable if the suit is lost or the permission is withdrawn.

Who is an indigent person under Order 33 CPC?

A person is treated as indigent if they do not have sufficient means to pay the court fee prescribed for the plaint, ignoring property exempt from attachment and the property in dispute. The test is ability to pay the fee for that particular suit, so the court looks at actual income and assets rather than a fixed income limit.

Does a pauper suit mean I never have to pay court fee?

Not necessarily. If you win, the court works out the court fee you would have paid, and the State Government can recover it from whichever party the decree orders to pay it. It is also a first charge on the subject matter of the suit. If you lose, the court will order you to pay it. Permission can also be withdrawn if you act vexatiously or improperly, if your means are such that you should no longer sue as an indigent person, or if someone else has acquired an interest in the subject matter of the suit. It removes the upfront barrier, not the liability.

Can I get free legal aid as well as exemption from court fee?

Yes, these are separate. Legal services authorities at taluk, district and state level provide free advocates to eligible persons under the Legal Services Authorities Act, 1987, and the court can also assign a pleader to an indigent person. Contact the District Legal Services Authority at your district court.

What happens if my indigent application is rejected?

Rejection does not end your claim. You can usually file the same suit in the ordinary way by paying the required court fee, after paying any costs the court ordered on the rejected application, and the court may allow time for the fee. The time spent on the indigent application is generally counted in your favour for limitation if the fee is paid within the time allowed. Take advice promptly.

Who is eligible for free legal aid in India?

Section 12 of the Legal Services Authorities Act, 1987 covers members of Scheduled Castes and Scheduled Tribes, victims of trafficking or begar, women and children, persons with disability, victims of mass disaster, caste atrocity, flood, drought or similar hardship, industrial workmen, persons in custody, and persons whose annual income is below the limit set by the State Government, or by the Central Government for Supreme Court cases. Income limits differ between States, so ask the District Legal Services Authority.

Is court fee refunded if the court sends the case to mediation or Lok Adalat and it settles?

Under section 16 of the Court-fees Act, 1870, where the court refers the parties to one of the settlement methods in section 89 of the Code of Civil Procedure, the plaintiff is entitled to a certificate to receive back the full court fee paid on the plaint. Section 21 of the Legal Services Authorities Act, 1987 also provides for refund where a case referred to a Lok Adalat is settled there. A settlement reached privately, without such a referral, is not covered by section 16. Court fees in courts other than the Supreme Court fall under the State List, and several States, such as Maharashtra, have their own Court Fees Acts with their own refund rules, so check the law that applies to your court. A refund only matters where a fee was actually paid, not where you were allowed to sue as an indigent person.

Is there a fee waiver for small consumer claims?

For disputes about goods or services, a complaint can be filed before a Consumer Commission. Under rule 7 of the Consumer Protection (Consumer Disputes Redressal Commissions) Rules, 2020, as amended in August 2023, no fee is payable where the value of goods or services paid as consideration is up to Rs 5 lakh. Higher fees apply above that. This is separate from the Order 33 procedure on this page, which is for civil suits.
