DRAFTING NOTES

One-year bar: under section 14 of the Act, a divorce petition cannot be presented within one year of the date of the marriage unless the court first gives leave on an application showing exceptional hardship to the petitioner or exceptional depravity on the part of the respondent.

Choose the ground carefully. The grounds in section 13 are specific. Irretrievable breakdown of marriage is not a ground under the Act, and saying that reconciliation is impossible does not by itself make out a ground. The grounds in section 13(2) are available only to a wife. Desertion must be for a continuous period of at least two years immediately before the petition. The one-year periods after a decree for judicial separation or restitution of conjugal rights run from the date of that decree.

Facts: section 20(1) requires the facts to be stated as distinctly as the case permits. Describe each incident with its date and place rather than general words like "harassment".

Verification: section 20(2) requires the petition to be verified like a plaint. Fill in the paragraph numbers by hand, separating facts you know yourself from facts you have been told (Order VI Rule 15 of the Code of Civil Procedure, 1908). Order VI Rule 15(4) requires an affidavit in support of the petition.

Do not hide earlier or pending cases between you and your spouse in paragraph 6. Concealment can count against you.

Remarriage: under section 15 of the Act, either party may remarry only after the time for appeal against the decree has expired with no appeal filed, or after any appeal has been dismissed.

तलाक याचिका (विवादित): यह क्या है

A contested divorce petition is filed by one spouse asking the court to dissolve the marriage on a ground recognised by law, such as cruelty or desertion, when the other spouse does not agree to a mutual consent divorce. This version is drafted under the Hindu Marriage Act, 1955 and records the marriage, the grounds with facts, and the request for a decree of divorce.

जब आपको इस दस्तावेज़ की आवश्यकता होती है

  • One spouse has treated the other with physical or mental cruelty and refuses to agree to a mutual divorce.
  • A spouse has deserted the other without reasonable cause for a continuous period of at least two years.
  • The other spouse has committed adultery or has converted to another religion.
  • A decree of restitution of conjugal rights or judicial separation has not been followed for a year or more.

इसमें क्या शामिल है

  • The court's name and the names and addresses of the petitioner and the respondent spouse.
  • The date and place of the marriage, where the parties last lived together, and details of any children.
  • The specific ground under section 13 of the Hindu Marriage Act relied on, and the facts that make it out.
  • Particulars of earlier or pending cases between the parties, and statements that there is no collusion, no condonation and no unnecessary delay.
  • The ground on which the court has jurisdiction, a prayer for a decree of divorce and costs, and a verification.

  1. Identify the exact legal ground that fits your facts and gather evidence for each incident, with dates.

  5. Serve notice on your spouse and attend mediation or counselling if the court refers you.

  • Evidence supporting the grounds, such as medical records, police complaints, messages or letters

इसके पीछे का कानून

The Hindu Marriage Act, 1955 applies to Hindus, Buddhists, Jains and Sikhs. Section 13 lists grounds such as adultery, cruelty, desertion for two continuous years, conversion, serious mental disorder, communicable venereal disease, renunciation of the world and not being heard of for seven years. A wife has some additional grounds. A petition cannot normally be filed within one year of marriage unless the court allows it for exceptional hardship. Irretrievable breakdown is not a ground under the Act. Other communities use their own laws, such as the Special Marriage Act, 1954 or the Divorce Act, 1869.

बचने के लिए आम गलतियाँ

  • Writing vague allegations like 'mental torture' without describing actual incidents and dates.
  • Filing in a court that lacks territorial jurisdiction under the Act.
  • Concealing earlier petitions or pending criminal cases between the parties.
  • Remarrying before the appeal period expires or while an appeal against the decree is pending.

तलाक याचिका (विवादित): अक्सर पूछे जाने वाले प्रश्न

What counts as cruelty for divorce?

Cruelty can be physical or mental. Courts have accepted persistent abuse, false criminal complaints, refusal of marital obligations without reason, and humiliating behaviour as cruelty, depending on facts. Ordinary wear and tear of married life is not enough. The conduct must make it unreasonable to expect the petitioner to continue living with the spouse.

Can I get a divorce if my spouse does not agree?

Yes, if you prove a ground under the law. Consent of the other spouse is needed only for a mutual consent divorce. In a contested case the court decides on evidence, and the respondent can defend. If the ground is proved, the decree can be passed even over the respondent's objection.

Can I file for divorce within one year of marriage?

Under the Hindu Marriage Act, a divorce petition cannot ordinarily be presented within one year of the marriage. The court may allow it earlier in cases of exceptional hardship to the petitioner or exceptional depravity by the respondent, on a separate application.

Can I claim maintenance during the divorce case?

Yes. Either spouse with insufficient income can ask for interim maintenance and litigation expenses while the case is pending. Permanent alimony can be decided at the time of the decree or afterwards. A wife may also have a separate claim under section 144 of the Bharatiya Nagarik Suraksha Sanhita.

How long does a contested divorce case take?

There is no fixed period, but section 21B of the Hindu Marriage Act says every petition shall be tried as expeditiously as possible and the court shall try to conclude the trial within six months from the date notice is served on the respondent. The trial is to continue from day to day unless the court records reasons for an adjournment. An appeal is to be heard, as far as possible, within three months of notice of the appeal. In practice the time depends on the court's workload and how many witnesses each side examines.

Can the court grant judicial separation instead of divorce?

Yes. Under section 13A of the Hindu Marriage Act, in a divorce petition the court may, if it considers it just in the circumstances, pass a decree for judicial separation instead of divorce. This alternative is not available where the petition is based on conversion to another religion, renunciation of the world, or the respondent not being heard of for seven years. A decree of judicial separation followed by one year or more without resumption of cohabitation is itself a ground for divorce under section 13(1A).

Can my spouse file a counter claim for divorce in the same case?

Yes. Section 23A of the Hindu Marriage Act lets the respondent in a divorce case oppose the petition on the ground of the petitioner's adultery, cruelty or desertion and also make a counter claim for relief on that ground. If the respondent proves it, the court can give the respondent the relief they would have got by filing their own petition. If both spouses file separate divorce petitions in different district courts, section 21A requires the later petition to be transferred and heard with the earlier one.
