प्रमाणित प्रतिलिपि के लिए आवेदन: यह क्या है

An Application for Certified Copy is a short request to a court's copying section for an official copy of a judgment, order, deposition or other paper on the court record. The copy is stamped and signed as a true copy by the authorised court officer, so it can be filed in an appeal, review, execution or other proceeding and relied on as proof of the original.

जब आपको इस दस्तावेज़ की आवश्यकता होती है

  • You have lost a case and need a certified copy of the judgment and decree to file an appeal.
  • You want to file a review petition or revision and the court requires the impugned order to be annexed.
  • You are starting execution and need a certified copy of the decree.
  • A bank, registrar, passport office or another court asks for a certified copy of a court order, such as a divorce decree or succession certificate.

इसमें क्या शामिल है

  • The name of the court and the case number in which the document was passed or filed.
  • The applicant's name, shown as the person seeking the copy.
  • A description of the exact document wanted, such as the judgment dated on a particular day or a specific order.
  • A statement that the copy is needed for further proceedings in the matter.
  • An undertaking by the applicant to pay the prescribed copying fees.
  • A prayer asking the court to direct issue of the certified copy, with the applicant's signature and date.

इसे कैसे भरें, हस्ताक्षर करें और उपयोग करें

  1. Collect the exact case number, year, court and the date of the order or judgment you want, ideally from the cause list or the court's online case status.
  2. Fill in the form on this page and check that the document description matches the record exactly, including dates.
  3. Print and sign the application. If you are not a party to the case, check the local rules, as some courts ask third parties to explain their interest or obtain the court's permission.
  4. Submit it at the copying section of the court and pay the copying charges and any court fee stamp the local rules require. Ask whether an urgent copy option is available if a deadline is close.
  5. Keep the receipt or application number, because the date on it is used to work out the time spent obtaining the copy.
  6. Collect the certified copy on the notified date, check that every page carries the certification and seal, and keep the original safe.

संलग्न करने या रखने के लिए दस्तावेज़

  • Copying fee or court fee stamps as required by the court's rules.
  • Copy of identity proof, where the copying section asks for it.
  • Vakalatnama or authority letter, if an advocate or clerk is applying on your behalf.

इसके पीछे का कानून

In civil cases, certified copies are issued under the Code of Civil Procedure, 1908 and the civil rules of practice framed by each High Court, which set the copying charges, forms and timelines. In criminal cases, copies are governed by section 404 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and the High Court rules made under it. These rules differ from state to state. Under the Bharatiya Sakshya Adhiniyam, 2023, a certified copy of a public document such as a court order can be produced as proof of its contents. The Limitation Act, 1963 excludes the time reasonably taken to obtain a certified copy when calculating the limitation period for an appeal or review, which is why the application date matters.

बचने के लिए आम गलतियाँ

  • Giving a wrong case number or order date, which sends the request back or produces a copy of the wrong document.
  • Applying late, after the appeal period has largely run out, and then assuming all the waiting time will be excluded.
  • Relying on a photocopy or a downloaded order where the court or authority specifically asks for a certified copy.
  • Not collecting the copy on time, as some courts treat unclaimed copies as abandoned after a period.

प्रमाणित प्रतिलिपि के लिए आवेदन: अक्सर पूछे जाने वाले प्रश्न

What is the difference between a certified copy and a free copy of a judgment?

Parties often receive a free or plain copy, and many judgments can now be downloaded from court websites. These are useful for reading, but a certified copy carries the court officer's certification that it is a true copy of the original. Appeals, execution and many official authorities insist on the certified version.

How long does it take to get a certified copy from court?

It depends on the court and its workload. Ordinary copies may take from a few days to a few weeks, and many courts offer an urgent category for a higher charge. Some High Courts and district courts also accept online applications. Ask the copying section for the expected date when you apply.

Can a person who is not a party to the case apply for a certified copy?

Judgments and orders are generally treated as public records, and many courts allow third parties to obtain copies of them. Pleadings, evidence and other papers may be restricted, and the court rules may require the third party to explain their interest or get permission. Check the rules of the particular court.

Is the time spent getting a certified copy excluded from limitation for appeal?

Yes, the Limitation Act excludes the time requisite for obtaining a copy of the decree or order when computing the period for an appeal or review. Only time that was actually needed counts, so apply promptly after the order and keep your application receipt as proof of the date.

How do I get a certified copy of a judgment in a criminal case?

Under section 404 of the Bharatiya Nagarik Suraksha Sanhita, 2023, an accused sentenced to imprisonment gets a copy of the judgment free immediately after it is pronounced. On application, the accused gets a certified copy, free where the judgment is appealable by the accused. Any other person affected by the judgment or order can apply and pay the prescribed charges. Persons not affected can obtain copies under High Court rules, on the fees and conditions those rules set.

Does an accused have to apply for copies of the FIR and charge sheet?

No separate copy application is needed for these. In a case started on a police report, section 230 of the Bharatiya Nagarik Suraksha Sanhita, 2023 requires the Magistrate to give the accused, free of cost and within fourteen days of production or appearance, copies of the police report, the FIR, witness statements, confessions and other documents sent with the report. Voluminous documents may be supplied electronically or offered for inspection. Use a copy application for other records.

What must a certified copy show to be valid?

Under section 75 of the Bharatiya Sakshya Adhiniyam, 2023, the officer who has custody of a public document gives a copy on payment of the legal fees, with a certificate at the foot stating that it is a true copy. The certificate must be dated and signed by the officer with name and official title, and sealed where the officer is authorised to use a seal. Check that the copy carries this certificate before you file it.
