Deficiency in service

Any fault, shortcoming or inadequacy in the quality or manner of a service that the provider was bound to give by law or contract. It is a ground for a consumer complaint.

If a bank, builder, airline, hospital, insurer, telecom company or any other service provider fails to deliver what it promised, or does it badly, that may be deficiency in service, and you can complain to a Consumer Commission.

The law behind it

Section 2(11) of the Consumer Protection Act, 2019 defines deficiency as any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance required by law, by contract or as claimed by the service provider. It includes negligence, omission or deliberately withholding relevant information that causes loss or injury to the consumer.

Where to file

Under the 2021 jurisdiction rules, complaints go by the value of goods or services paid for: up to Rs 50 lakh to the District Commission, above Rs 50 lakh and up to Rs 2 crore to the State Commission, and above Rs 2 crore to the National Commission. Complaints can be filed online on the e-Jagriti portal, and from where the complainant lives or works.

Time limit

A complaint must be filed within two years from when the cause of action arose (Section 69), though the Commission can admit a later complaint for sufficient cause.

  • Keep bills, receipts, emails and screenshots.
  • Complain to the provider first and keep their reply.
  • Send a legal notice where useful, then file the complaint.

Draft a deficiency in service complaint or a consumer complaint, and read filing a deficiency in service complaint online.
