FIXED-TERM EMPLOYMENT CONTRACT This CONTRACT is made on [contract_date] between [company_name], of [company_address] (the "Company"), and [employee_name], of [employee_address] (the "Employee"). 1. APPOINTMENT AND TERM 1.1 The Company appoints the Employee as [designation] for a FIXED TERM commencing on [start_date] and ending on [end_date]. 1.2 This contract shall EXPIRE AUTOMATICALLY on the end date, by efflux of time, without any notice or payment in lieu being required from either party. 1.3 Expiry by efflux of time does not constitute retrenchment, and the Employee shall have no claim on that basis. The parties record that the non-renewal of a contract of employment for a fixed term, on its expiry, is excluded from the definition of retrenchment under the Industrial Disputes Act, 1947. 1.4 Continuation beyond the end date requires a fresh written contract. Continued attendance without one shall not be construed as renewal or as creating permanent employment. 2. PLACE OF WORK [work_location] 3. DUTIES [duties] The Employee shall additionally perform such other duties consistent with the position as may reasonably be assigned, and shall devote their whole working time to the Company's business during the term. 4. REMUNERATION 4.1 The Employee shall be paid an annual cost to company of Rs. [annual_ctc], payable monthly, subject to deduction of tax at source and other statutory deductions. 4.2 Salary shall be paid pro rata for any part of a month worked. 5. STATUTORY BENEFITS 5.1 The Employee shall be covered under the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 and, where applicable, the Employees' State Insurance Act, 1948, on the same basis as a permanent employee in the same grade. 5.2 The Employee shall be entitled to leave, hours of work and other conditions of service no less favourable than those applicable to a permanent employee doing the same work. 5.3 Gratuity shall be payable where the Employee completes the qualifying period of continuous service prescribed under the Payment of Gratuity Act, 1972. 6. EARLY TERMINATION 6.1 Either party may terminate before the end date by giving [notice_days] days' written notice, or salary in lieu. 6.2 The Company may terminate forthwith, without notice, for misconduct, breach of policy, wilful neglect of duty or dishonesty. 7. CONFIDENTIALITY AND INTELLECTUAL PROPERTY 7.1 The Employee shall keep confidential all non-public information of the Company, during the term and after it. 7.2 All intellectual property created by the Employee in the course of employment, and relating to the Company's business, shall vest in the Company. 8. RETURN OF PROPERTY On expiry or termination, the Employee shall return all Company property, documents, data, devices and access credentials. 9. WORKPLACE CONDUCT The Employee shall comply with the Company's policies, including its policy under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. 10. GOVERNING LAW Governed by the laws of India, with the courts at the Company's registered office having jurisdiction.
