THE RULES ARE SPECIFIC, AND THAT HELPS YOU

Complaints about noise are often dismissed as a matter of tolerance between neighbours. The Noise Pollution (Regulation and Control) Rules, 2000 make it more concrete than that.

NIGHT HOURS are 10 p.m. to 6 a.m. Loudspeakers and public address systems are NOT permitted at night, except inside closed premises such as auditoriums and halls, during a public emergency, or where the State has allowed use up to midnight on a limited number of festival occasions in the year. This is the single most useful fact in a noise complaint, because it converts "it is too loud" into "it is after ten".

AMBIENT STANDARDS differ by area: industrial, commercial, residential and SILENCE ZONE, the last being the area of at least 100 metres around hospitals, educational institutions and courts, where limits are strictest. Establish which zone you are in; it changes what is permissible.

WHAT MAKES A COMPLAINT WORK:

  • DATES AND TIMES, written down as they happen. "Every night between 11 and 2, on the following dates" is actionable; "constant noise" is not.
  • RECORDINGS with a visible timestamp.
  • OTHER RESIDENTS. A complaint signed by several households is treated very differently from one signed by an individual, who is easily characterised as over-sensitive.
  • A WRITTEN COMPLAINT WITH AN ACKNOWLEDGMENT, so escalation has a starting point.

WHERE TO GO: the police for immediate action on loudspeakers and late-night noise; the State Pollution Control Board for measurement and sustained industrial or commercial noise; and the municipal authority where a trade licence condition is being breached. For construction noise, the site's own permissions usually specify permitted hours.

Public nuisance is also addressable by a Magistrate on a complaint, and persistent noise affecting a neighbourhood is a recognised civil wrong for which an injunction can be sought.

சத்தம் தொந்தரவு புகார்: அது என்ன

A noise nuisance complaint is a written complaint to the police, State Pollution Control Board or municipal office about persistent noise from a neighbour, event, shop or factory. It describes the source, timing and effect of the noise and asks the authority to measure it, stop it and tell you in writing what action was taken.

உங்களுக்கு இந்த ஆவணம் தேவைப்படும்போது

  • A neighbour plays loud music or holds parties late into the night on a regular basis.
  • A loudspeaker is used at an event, shop or gathering after 10 p.m.
  • A factory, generator set or workshop near your home runs noisy machinery for long hours.
  • Construction work in your area continues at night or outside its permitted hours.

அது எதை உள்ளடக்கியது

  • The authority it is addressed to, the date, and your name, address and contact number.
  • The source of the noise and its location.
  • The nature of the noise and when it occurs.
  • The effect on you and other residents, and your earlier attempts to resolve it.
  • A statement that you believe the noise exceeds the standards under the Noise Pollution (Regulation and Control) Rules, 2000 and continues during hours when it is not allowed, with a request to verify this by measurement.
  • A request to measure the noise, stop it, take action in law and inform you in writing, with an acknowledgment section.

அதை எவ்வாறு நிரப்புவது, கையொப்பமிடுவது மற்றும் பயன்படுத்துவது

  1. Keep a written log of each incident with date, start time and end time for at least a week or two.
  2. Record short videos or audio clips that show the time, and ask other affected households to join or sign the complaint.
  3. Fill in the form on this page and check the preview, giving specific dates and times rather than general statements.
  4. Choose the right authority: the police for loudspeakers and late night noise, the State Pollution Control Board for industrial or commercial noise, and the municipal office for licence breaches.
  5. Sign and submit the complaint, and have the acknowledgment section filled in with the date and a reference number.
  6. For noise happening right now at night, call the local police or 112, then follow up on the written complaint.
  7. If nothing changes, escalate in writing to senior officers or approach the Magistrate or civil court.

இணைக்க வேண்டிய அல்லது அதனுடன் வைத்திருக்க வேண்டிய ஆவணங்கள்

  • Log of incidents with dates and times.
  • Audio or video recordings with visible timestamps.
  • Signatures or letters from other affected residents.
  • Copies of earlier complaints or letters to the society or the person responsible.

அதன் பின்னணியில் உள்ள சட்டம்

The Noise Pollution (Regulation and Control) Rules, 2000, made under the Environment (Protection) Act, 1986, set ambient noise limits for industrial, commercial, residential and silence zones. A silence zone is an area of not less than 100 metres around hospitals, educational institutions, courts, religious places or any other area declared as such by the competent authority. Night time is 10 p.m. to 6 a.m., and loudspeakers and public address systems are generally not allowed at night except in closed premises, with limited exceptions the state may permit on certain occasions. Public nuisance is an offence under the Bharatiya Nyaya Sanhita, 2023, and a Magistrate can order removal of a nuisance under the Bharatiya Nagarik Suraksha Sanhita, 2023. Civil courts can grant injunctions for persistent nuisance.

தவிர்க்க வேண்டிய பொதுவான தவறுகள்

  • Writing that the noise is constant without dates and times, which makes the complaint easy to dismiss.
  • Sending the complaint to the wrong authority, for example the police for factory noise that needs Pollution Control Board measurement.
  • Complaining alone when other households are equally affected, which weakens the complaint.

What time is loud music not allowed in India?

Under the Noise Pollution Rules, night time is from 10 p.m. to 6 a.m. Loudspeakers and public address systems are generally not permitted at night except in closed premises such as auditoriums and community halls. The state government can allow use up to midnight on a limited number of festival or cultural occasions in a year.

Can I call the police for a neighbour's loud music?

Yes. For loud music, loudspeakers or parties going on late at night, call the local police station or 112 for immediate action. Police can ask for the noise to stop and take action under the rules. Follow up with a written complaint if the problem keeps happening.

Who measures noise levels if I complain?

The State Pollution Control Board or Pollution Control Committee usually measures ambient noise with calibrated equipment, especially for industrial or commercial sources. Some police departments and municipal bodies also have noise meters. Ask the authority to measure during the hours when the noise actually occurs.

What is a silence zone?

A silence zone is an area of not less than 100 metres around hospitals, educational institutions, courts, religious places or any other area that the competent authority declares as a silence zone under the Noise Pollution Rules. Noise limits are strictest there, and using loudspeakers, horns or firecrackers in these areas is restricted. If the noise source is near such a place, say so in your complaint.

What noise level is allowed in a residential area?

The Schedule to the Noise Pollution (Regulation and Control) Rules, 2000 fixes 55 dB(A) Leq by day and 45 dB(A) Leq at night for residential areas. Day time is 6 a.m. to 10 p.m. A privately owned sound system or instrument must not raise the noise at the boundary of the private place by more than 5 dB(A) above the limit for that area.

To whom can I complain under the noise rules, and when?

Rule 7 lets any person complain to the authority if noise exceeds the area limit by 10 dB(A) or more, or if the night time restrictions are broken. The authority includes the District Magistrate, the Police Commissioner or an officer not below Deputy Superintendent of Police designated for the purpose. The authority must act on the complaint, and under Rule 8 it can issue written orders to stop or regulate the noise.

Is construction work allowed at night in a residential area?

No. Rule 5A of the Noise Pollution Rules says sound emitting construction equipment shall not be used or operated during night time, that is 10 p.m. to 6 a.m., in residential areas and silence zones. The same rule bars horns in silence zones and at night in residential areas except in a public emergency, and bars bursting sound emitting firecrackers in silence zones or at night.
