TIME LIMIT
Under Order VIII Rule 1 of the Code of Civil Procedure, 1908, a written statement must be filed within thirty days of service of summons. The court may allow it later, for reasons recorded in writing, up to ninety days from service. In ordinary civil suits the Supreme Court has held this ninety-day limit to be directory rather than mandatory (Kailash v. Nanhku, 2005), so a later filing may be allowed in exceptional cases, usually on costs, but do not rely on it. In commercial disputes governed by the Commercial Courts Act, 2015, the outer limit of one hundred and twenty days is mandatory, and the right to file is forfeited thereafter. Do not allow this period to lapse.
PLEAD EVERY OBJECTION NOW
Order VIII Rule 2 requires the defendant to raise in the written statement every ground that shows the suit is not maintainable, and every fact that would otherwise take the plaintiff by surprise, such as limitation, fraud, release, payment or lack of jurisdiction. Put them in the preliminary objections with the supporting facts (for example, the dates showing the suit is time-barred). The template does not plead limitation, unclean hands or absence of loss for you, because those must be true and specific to your case.
SPECIFIC DENIAL
An allegation of fact in the plaint that is not denied specifically or by necessary implication may be taken as admitted under Order VIII Rule 5. Deny each material allegation specifically in the paragraph-wise reply.
AFFIDAVIT AND VERIFICATION
Order VI Rule 15(4) requires the person verifying a pleading to also furnish an affidavit in support. In a commercial suit, the written statement is verified by a statement of truth in the prescribed form. In the first blank, list the paragraph numbers that are true to your own knowledge (what you did, saw, signed or received). In the second, list the paragraphs based on information from others or on documents, which you believe to be true. Order VI Rule 15 of the Code of Civil Procedure, 1908 requires this paragraph-wise split. Do not verify everything as true to knowledge if it is not.
COUNTER-CLAIM
A counter-claim is treated as a plaint, so it must set out its own cause of action and valuation, and court fee is payable on it. Leave the field blank if you have none.
लिखित वक्तव्य (सिविल जवाब): यह क्या है
A written statement is the defendant's formal reply to a plaint in a civil suit under Order VIII of the Code of Civil Procedure, 1908. It raises preliminary objections, admits or denies each paragraph of the plaint, sets out the defendant's own version of the facts, and can include a counter-claim. Whatever is not specifically denied in it may be treated as admitted.
जब आपको इस दस्तावेज़ की आवश्यकता होती है
- You have been served with summons and a plaint in a civil suit and must file your defence.
- The suit appears to be time-barred or filed in a court without jurisdiction and you want to raise these objections.
- You have your own claim against the plaintiff and want to file it as a counter-claim in the same suit.
- The plaintiff has misstated facts about a property, contract or money dispute and you need to put your version on record.
इसमें क्या शामिल है
- Court name, suit number, the parties, and a heading under Order VIII CPC.
- Your preliminary objections, such as limitation, jurisdiction or maintainability, each with the facts that support it.
- A general denial of all averments not specifically admitted, followed by your paragraph-wise reply.
- Your own version of the facts and additional pleas of good faith and that the reliefs claimed are not sustainable.
- A counter-claim, if any, and a prayer to dismiss the suit with costs.
- A verification stating which paragraphs are true to your knowledge and which are based on information.
इसे कैसे भरें, हस्ताक्षर करें और उपयोग करें
- Note the date summons was served on you, because the filing period runs from that date.
- Read the plaint paragraph by paragraph and mark each as admitted, denied or not known.
- Fill in the form on this page with your objections, paragraph-wise reply, your version of facts and any counter-claim.
- Have an advocate review it before filing, because points not pleaded now are hard to raise later, unanswered averments may be treated as admitted, and a counter-claim may need court fee.
- Sign and verify the written statement, and in a commercial suit add the statement of truth required by the Commercial Courts Act.
- File it with the documents you rely on and serve a copy on the plaintiff or their advocate.
- Keep the filing receipt and a full copy for hearings and evidence.
संलग्न करने या रखने के लिए दस्तावेज़

इसके पीछे का कानून
Order VIII of the Code of Civil Procedure, 1908 governs the written statement. Rule 1 requires it within 30 days of service of summons, and the court may extend this for recorded reasons up to 90 days, a limit the Supreme Court treats as directory in ordinary suits. In commercial suits under the Commercial Courts Act, 2015, the 120-day outer limit is strict and the right to file is lost after it. Rule 2 requires every defence of non-maintainability, such as limitation or fraud, to be pleaded. Rule 5 says allegations not specifically denied may be treated as admitted. The CPC also allows set-off and counter-claims within the written statement.
बचने के लिए आम गलतियाँ
- Missing the filing deadline, which in a commercial suit ends the right to file altogether.
- Giving evasive or general denials instead of answering each paragraph specifically.
- Not filing the documents you rely on along with the written statement.
- Raising limitation or jurisdiction objections only later instead of pleading them at the start.
लिखित वक्तव्य (सिविल जवाब): अक्सर पूछे जाने वाले प्रश्न
What is the time limit to file a written statement?
Ordinarily 30 days from service of summons. The court can extend it for recorded reasons up to 90 days in a normal civil suit. In a commercial suit the outer limit is 120 days and the right to file is forfeited after that. Do not count on extensions.
What happens if I do not file a written statement?
The court may proceed against you, close your right to file a defence and pass judgment on the plaintiff's case. You may still be able to cross-examine witnesses in some cases, but you lose the chance to put your own version on record properly.
What is the difference between a written statement and a counter-claim?
A written statement defends against the plaintiff's claim. A counter-claim is your own claim against the plaintiff, made in the same suit so both are decided together. A counter-claim is treated like a plaint, so it may need court fee and the plaintiff gets a chance to reply to it.
Does a written statement need notarisation?
It must be signed and verified by the defendant, and Order VI Rule 15(4) requires a supporting affidavit. Commercial suits require a statement of truth. Whether the affidavit must be sworn before an oath commissioner or notary depends on the court's rules, so check with the registry or your advocate.
Can I file documents after the written statement has been filed?
Order VIII Rule 1A of the Code of Civil Procedure, 1908 requires the defendant to list the documents relied on and produce them in court when the written statement is presented. Under Rule 1A(3), a document that should have been produced but was not cannot be received in evidence at the hearing without the leave of the court. Rule 1A(4) exempts documents produced only to cross-examine the plaintiff's witnesses or handed to a witness to refresh memory. In a commercial suit, Order XI as amended by the Commercial Courts Act, 2015 applies, and under Order XI Rule 1(10) the defendant cannot rely on undisclosed documents that were in its power except with the court's leave, which is granted only if it shows reasonable cause for not disclosing them with the written statement.
Can I amend my written statement later?
Order VI Rule 17 of the Code of Civil Procedure, 1908 allows the court to permit a party to amend its pleadings at any stage on just terms, where the amendment is needed to decide the real questions in controversy. The proviso says no amendment application shall be allowed after the trial has commenced, unless the court concludes that the party could not have raised the matter earlier in spite of due diligence. This is why every defence should be pleaded in the first written statement.
Can my counter-claim be about something that happened after the suit was filed?
Yes, within limits. Order VIII Rule 6A of the Code of Civil Procedure, 1908 allows a counter-claim on a cause of action that accrued to the defendant either before or after the suit was filed, but before the defendant delivered the defence or before the time for delivering it expired. The counter-claim must not exceed the pecuniary limits of the court's jurisdiction, and it has the same effect as a cross-suit, so the court can give a final judgment on both claims in the same suit.
