DRAFTING NOTES

This trust operates only on death, so the document is a testamentary instrument and must be executed like a Will: signed by you and attested by at least two witnesses, each of whom sees you sign (or receives your acknowledgment of your signature) and signs in your presence (section 63 of the Indian Succession Act, 1925).

Do not use a beneficiary, or a beneficiary's spouse, as a witness. Under section 67 of that Act a bequest to an attesting witness or their spouse is void. Avoid using the trustee as a witness as well.

Make sure your main Will refers to this trust and does not leave the same assets to someone else. A later Will that is inconsistent with this document can defeat the trust, and a later Will that revokes all earlier wills and codicils, as most Wills do, will revoke this document too unless the new Will expressly keeps it in force.

Say clearly when the trust ends and who receives what is left, for example when the youngest beneficiary reaches a stated age. Very long trusts for unborn persons can fall foul of the rules against remoteness in the Indian Succession Act, so take advice if the trust is to last beyond the lifetime of persons now living.

Ask the trustee and the substitute trustee whether they are willing to act before you sign.

કરારની ટ્રસ્ટ ડીડ: તે શું છે

A Testamentary Trust Deed sets out assets that are to be held in trust after your death, names a trustee to manage them, and says who benefits and on what terms. Because it takes effect only on death as part of your Will, it must be made with the same formalities as a Will.

જ્યારે તમને આ દસ્તાવેજની જરૂર હોય

  • You want money or property for your minor children to be managed by a trustee until they reach a stated age.
  • A dependent family member, such as a child with a disability or an elderly parent, needs long-term financial support managed for them.
  • You do not want a beneficiary to receive a large sum at once and prefer it paid out in stages.
  • You want a particular property kept intact for the family rather than sold immediately after your death.

તે શું આવરી લે છે

  • Your name and address as settlor or testator, a statement that you are of sound mind, and the place and date of signing.
  • A statement that the document is testamentary, takes effect on your death as part of your Will of a stated date, and otherwise takes effect as your Will for the trust assets.
  • A direction that the listed assets are to be held in trust on your death, and the names of the trustee and a substitute trustee.
  • The beneficiaries of the trust, and the purpose and terms of the trust as you enter them.
  • When the trust ends and who receives the remaining assets, with a fallback to your residuary estate, and a clause requiring the trustee to manage the assets prudently under the Indian Trusts Act, 1882.
  • Your signature and an attestation by two witnesses who each saw you sign and signed in your presence, as section 63 requires.

તેને કેવી રીતે ભરવું, સહી કરવી અને તેનો ઉપયોગ કરવો

  1. Decide the assets, beneficiaries, payment timing and end date of the trust, and ask the trustee whether they will accept.
  2. Fill in the form and check that the assets and beneficiaries match exactly what your main Will says.
  3. Have an advocate review it before signing, because a testamentary trust must work together with your Will, and a mismatch or a later inconsistent Will can defeat the trust.
  4. Sign it in the presence of two witnesses who both sign in your presence, preferably people who are not beneficiaries or the trustee.
  5. Refer to this document in your Will, or include its terms in the Will itself, so that the executor treats it as part of your testamentary plan.
  6. Optionally register it with your Will, and keep the original alongside the Will.
  7. Review it when your family or assets change.

જોડવા અથવા તેની સાથે રાખવા માટેના દસ્તાવેજો

  • Your Will, or a copy of it, which should refer to this trust.
  • A list of assets with account numbers, folio numbers or property details.
  • Identity proof of the trustee and, where available, the beneficiaries.
  • Written consent of the trustee, if obtained.

તેની પાછળનો કાયદો

The Indian Trusts Act, 1882 governs private trusts, including the duties of trustees and the rights of beneficiaries. Section 5 of that Act allows a trust of immovable property to be created by the Will of the person setting it up. Because this trust operates only on death, the document is testamentary and must meet the Indian Succession Act, 1925 requirements for a Will: in writing, signed by you and attested by at least two witnesses. A Will needs no stamp duty and registration is optional.

ટાળવા માટેની સામાન્ય ભૂલો

  • Signing the trust document without two attesting witnesses, which can make it ineffective as a testamentary document.
  • Leaving the same asset to an individual in the Will while also placing it in the trust here.
  • Not saying when the trust ends or what happens to remaining assets when it does.
  • Naming a single trustee with no substitute if that person dies first or refuses to act.

કરારની ટ્રસ્ટ ડીડ: વારંવાર પૂછાતા પ્રશ્નો

What is the difference between a testamentary trust and a family trust?

A family trust set up during your lifetime starts working immediately and the assets leave your name. A testamentary trust starts only on your death, through your Will, so you keep full control of the assets while alive and can change or revoke the arrangement at any time.

Does a testamentary trust need registration or stamp duty?

Because it operates through a Will, it carries no stamp duty and registration is optional. Registering it along with your Will can make it harder to dispute. After your death, the trustee may need to complete the usual transfer formalities for each asset.

Can I be my own trustee?

No, because the trust begins only after your death. You must name someone else, such as a relative, a trusted friend or a professional trustee. Many people name two trustees, or a back-up trustee, so the trust can still run if one person is unable to act.

Will my executor need probate for the trust to work?

Probate is no longer compulsory for any community since the Repealing and Amending Act, 2025 omitted section 213 of the Indian Succession Act. Even so, banks, companies or registrars may ask for probate before releasing assets to the trustee, especially for large or disputed estates. Your advocate can tell you whether it is likely in your case.

Does this trust document have to be mentioned in my Will?

Not always, but a reference in the Will helps. Under section 64 of the Indian Succession Act, 1925, if a duly attested Will or codicil refers to another document that is already written as expressing part of the testator's intentions, that document is treated as part of the Will. The document must exist when the Will refers to it, so a Will cannot pick up a trust document written later. A trust document that is itself signed and attested like a Will can also take effect on its own as a testamentary document, but it should not conflict with the main Will.

Can a beneficiary of the trust sign as a witness?

The document stays validly attested, but whether the witness keeps the benefit depends on the law that governs the Will. Section 67 of the Indian Succession Act, 1925 says a Will is not insufficiently attested because a benefit is given to an attesting witness or that witness's husband or wife, but makes the gift to that witness or spouse void. Section 67 is not among the provisions that section 57 and Schedule III apply to Wills of Hindus, Buddhists, Sikhs and Jains, so that rule does not by its terms apply to their Wills. Section 68, which does apply to them, says a person is not disqualified as a witness merely because they have an interest or are the executor. Witnesses are still usually people who take nothing under the trust, because an interested witness can invite questions if the Will is challenged.

Can the trustee refuse the job, resign later, or charge a fee?

No one is bound to accept a trust, and under section 10 of the Indian Trusts Act, 1882 the person named may disclaim it within a reasonable period. Once accepted, section 46 allows a trustee to renounce only with the permission of the principal civil court, with the consent of a beneficiary who is competent to contract, or under a special power in the trust document. Under section 50, a trustee has no right to remuneration unless the trust document or a contract with the beneficiary or the court provides for it, so state any fee in the document.
