NOTES ON EXECUTION

LIMITATION: Article 136 of the Limitation Act, 1963 allows TWELVE YEARS from the date the decree becomes enforceable. Where the decree directs payment or delivery on a certain date or by instalments, time runs from the default in respect of which execution is sought. This is the longest limitation period in the Act, but it is absolute: a decree not executed within it can no longer be enforced.

FORM: Order XXI Rule 11(2) requires the application to be in writing, signed and verified by the decree holder (or a person acquainted with the facts), and to give the particulars in paragraph 1 in tabular form. Fill in every item, writing "None" where it does not apply, and fill in the paragraph numbers in the verification.

IMMOVABLE PROPERTY: Order XXI Rule 13 requires an application for attachment of immovable property to give a description sufficient to identify it, its boundaries or survey numbers where available, and the judgment debtor's share or interest so far as you have been able to ascertain it. Include these in the property field.

ARREST AND DETENTION is available only in the limited circumstances set out in the proviso to Section 51, and requires the court to record reasons for being satisfied that the judgment debtor has the means to pay and has refused or neglected to do so. Inability to pay is not a ground for detention.

EXEMPT PROPERTY: Section 60 of the Code exempts specified property from attachment, including necessary wearing apparel, cooking vessels, tools of an artisan, and a portion of salary. An attachment sought over exempt property will be refused.

TRANSFER: where the judgment debtor resides or holds property outside the jurisdiction of the court that passed the decree, that court may transfer the decree for execution under Section 39.

An execution petition is the application a decree holder files to enforce a civil court decree or order that the judgment debtor has not obeyed. Filed under section 51 and Order XXI of the Code of Civil Procedure, 1908, it states the decree, the amount still due and the mode of execution sought, such as attachment and sale of property, so the court can compel compliance.

  1. Get a certified copy of the decree and check whether any appeal or stay is pending.
  2. Work out the amount due, including interest and costs awarded, minus any amount already paid.
  3. Find out what the judgment debtor owns: land, house, vehicle, bank accounts or salary, with specific details.
  4. Fill in the details and have an advocate review it, because Order XXI requires specific particulars, the choice of execution mode matters, and errors about exempt property or jurisdiction lead to rejection.
  5. File it with the court that passed the decree, or ask that court to transfer the decree if the debtor or property is elsewhere.
  6. Attend hearings, respond to any objections from the judgment debtor, and follow up on attachment, sale or delivery orders.

त्यामागचा कायदा

The Code of Civil Procedure, 1908 governs execution. Section 51 allows the court to execute by delivering specific property, attaching and selling property, arresting and detaining the judgment debtor in limited cases, appointing a receiver, or other suitable means. Order XXI sets out the procedure and the particulars required. Section 60 exempts certain property from attachment, such as necessary clothing, tools of artisans and part of salary. Section 39 allows transfer of a decree to another court. Article 136 of the Limitation Act, 1963 gives 12 years from when the decree becomes enforceable to file for execution.

टाळता येण्यासारख्या सामान्य चुका

  • Not giving specific details of the judgment debtor's property, so the court cannot order attachment.
  • Seeking attachment of exempt items, such as household necessities or the protected part of salary.
  • Asking for arrest without material showing the debtor can pay and has refused, which courts decline.
  • Waiting years to file and losing track of the 12-year limitation period.

अंमलबजावणी याचिका वारंवार विचारले जाणारे प्रश्न

What is the time limit to file an execution petition?

Under Article 136 of the Limitation Act, 1963, an execution petition must be filed within 12 years from the date the decree becomes enforceable. After that, the decree generally cannot be executed. It is better to file early while the debtor's assets can still be traced.

Which court should I file the execution petition in?

Usually in the court that passed the decree. If the judgment debtor lives or owns property within another court's jurisdiction, you can ask the decree-passing court to transfer the decree under section 39 CPC, and then execute it in that court.

Can the judgment debtor be sent to jail for not paying?

Only in limited cases. Under the proviso to section 51, the court must be satisfied, for recorded reasons, that the debtor has the means to pay and has refused or neglected to pay. Mere inability to pay is not a ground for detention.

What if the judgment debtor has appealed?

Filing an appeal does not by itself stop execution. Execution is stayed only if the appellate court passes a stay order. If a stay is granted, execution waits until the stay is lifted or the appeal is decided.

How long should the court take to decide an execution petition?

In Rahul S. Shah v. Jinendra Kumar Gandhi (2021), the Supreme Court directed that the executing court must dispose of execution proceedings within six months from the date of filing, and may extend this only by recording reasons in writing. In Periyammal v. V. Rajamani (6 March 2025), the Court reiterated this direction and asked every High Court to collect pendency data and issue circulars so that pending execution petitions are decided within six months, failing which the presiding officer is answerable to the High Court on the administrative side.

How much of the judgment debtor's salary can be attached?

Under section 60(1)(i) of the Code of Civil Procedure, 1908, the first Rs 1,000 of salary and two-thirds of the remainder are exempt from attachment in execution of any decree other than a decree for maintenance. For a maintenance decree, clause (ia) exempts one-third of the salary. Under the proviso, once the attachable part has been under attachment for a total of 24 months, it becomes exempt for a further 12 months, and if the attachment was under the same decree, it becomes finally exempt from attachment under that decree.

Is the time limit the same for executing an injunction decree?

No. Article 136 of the Limitation Act, 1963 gives 12 years for executing a decree or order of a civil court, but it expressly excludes a decree granting a mandatory injunction. Enforcement of a mandatory injunction falls under Article 135, which allows three years from the date of the decree or from the date fixed for performance. Under the proviso to Article 136, an application to enforce or execute a decree granting a perpetual injunction is not subject to any period of limitation.
