DRAFTING NOTES

1. This deed records your wishes. It is not a court order, and on its own it carries persuasive value only. If guardianship is ever disputed, a court decides it under the Guardians and Wards Act, 1890, guided mainly by the welfare of the children, and treats your wishes as one important factor.

2. MAKE THE SAME APPOINTMENT IN YOUR WILL. For Hindus (including Sikhs, Jains and Buddhists), section 9 of the Hindu Minority and Guardianship Act, 1956 recognises the appointment of a guardian by a parent's will, subject to the rights of a surviving natural guardian. An appointment made only in a deed like this one is not a testamentary appointment. Name the same guardian in your Will, signed and attested as a will.

3. Muslim, Christian and Parsi families follow their own personal law on guardianship, together with the Guardians and Wards Act, 1890. Have an advocate confirm how an appointment should be made in your case.

4. While the other parent is alive, he or she usually remains the natural guardian. The person you name will ordinarily act only if both parents have died or a court decides otherwise.

5. Speak to the proposed guardian first. Do not use the proposed guardian or his or her spouse as a witness. Give copies to the guardian and a trusted family member.

A Guardian Appointment Deed records which person a parent wants to look after their minor children if the parent dies or becomes unable to care for them. It is a statement of the parent's wishes. As the document itself says, it is not a court order, and a court decides guardianship with the child's welfare as the main concern.

  • You are a single parent and want to name who should bring up your children if something happens to you.
  • Both parents travel together often and want a named guardian if both die at the same time.
  • You want a particular relative, such as a grandparent or sibling, to be preferred over others who might claim guardianship.
  • You are making a Will and want a separate signed record of your guardianship wishes.

  • The parent's name and address and a statement that the parent is the parent of the minor children named.
  • Details of each minor child, as entered in the form.
  • The name of the proposed guardian and that person's relationship to the parent.
  • A statement that the appointment applies in the event of the parent's death or incapacity.
  • A clause making clear that the declaration records the parent's wishes for the court under the Guardians and Wards Act, 1890, and is not itself a guardianship order.
  • A declaration of free will and sound mind, the date, the parent's signature and space for two witnesses.

  1. Speak to the person you want to appoint and confirm that they are willing and able to take on the children.
  2. Enter your details, the children's names and ages, and the guardian's details in the form, and check the spelling of every name against official records.
  3. Have an advocate review it before signing, because the weight it carries depends on your personal law, on whether the other parent is alive, and on how it fits with your Will.
  4. Print and sign it in the presence of two adult witnesses who are not the proposed guardian, and have them add their names and addresses.
  5. Mention the same guardian in your Will so that the two documents agree.
  6. Keep the original safe and give copies to the guardian and a trusted family member.

  • Birth certificates of the minor children.
  • Identity and address proof of the parent.
  • Identity and address proof of the proposed guardian.
  • A copy of your Will, if it also names a guardian.
  • A written consent from the proposed guardian, if you have one.

The Guardians and Wards Act, 1890 lets a court appoint a guardian for a minor's person or property, and the court must be guided mainly by the minor's welfare. The wishes of a deceased parent are one factor it considers. For Hindus, the Hindu Minority and Guardianship Act, 1956 also allows a parent to appoint a guardian by Will, subject to the rights of a surviving natural guardian. Muslim, Christian and Parsi families follow their own personal law on guardianship, so the effect of this deed varies.

  • Assuming the deed overrides the surviving parent, who is usually the natural guardian and is generally preferred unless the court finds otherwise.
  • Naming a guardian in this deed and a different person in the Will, which invites a dispute.
  • Not telling the chosen guardian, who may be unwilling or unable to act when the time comes.
  • Using a witness who is the proposed guardian or their spouse, which can raise questions about independence.

Is a guardian appointment deed binding on the court?

No. The court decides guardianship based on the child's welfare. A clear, properly signed deed is strong evidence of what the parent wanted, and courts usually give it real weight, but it does not guarantee that the named person will be appointed.

Does this deed need to be registered or on stamp paper?

Registration is not compulsory for this kind of declaration. Whether stamp paper is needed depends on your state's stamp law and on how the document is treated. Many people sign it with two witnesses and get it notarised for added proof. Check locally before signing.

What happens if the other parent is alive?

In most cases the surviving parent continues as the child's natural guardian, and a guardian you name will usually act only if both parents have died or the court finds the surviving parent unfit. The exact rule depends on your personal law, which is why advocate review is advisable.

Should I name a guardian in my Will instead?

Many people do both. A Will is the usual place for a testamentary guardian, and this deed gives a separate, signed statement of the same wish. What matters is that both name the same person and are kept up to date.

Where is a guardianship case filed after a parent dies, and who can file it?

Under section 8 of the Guardians and Wards Act, 1890, the application can be made by the person who wants to be guardian, by any relative or friend of the minor, or by the Collector. Section 9 says an application for guardianship of the child's person goes to the District Court where the minor ordinarily resides, and one for the child's property may also be made where the property is situated. Where a Family Court has been set up, section 7 of the Family Courts Act, 1984 gives it the district court's jurisdiction over guardianship and custody of minors.

Will the court consider the child's own wishes, and can it appoint someone who is unwilling?

Under section 17(3) of the Guardians and Wards Act, 1890, if the minor is old enough to form an intelligent preference, the court may consider that preference. Section 17(2) lists the other factors, including the child's age, sex and religion, the character and capacity of the proposed guardian, nearness of kin, the wishes of a deceased parent and existing relations with the child. Section 17(5) says the court shall not appoint any person as guardian against that person's will, so the person named must be willing to act.

Can the guardian sell or mortgage the child's property?

Not freely. For a Hindu minor, section 8(2) of the Hindu Minority and Guardianship Act, 1956 says a natural guardian needs the court's previous permission to sell, gift, mortgage or exchange any immovable property of the minor, or to lease it for more than five years or for more than one year beyond the date the minor attains majority, and section 8(4) allows permission only for necessity or evident advantage to the minor. A guardian appointed by will under that Act exercises a natural guardian's rights subject to the same restrictions under section 9(5). A guardian of property appointed by the court under the Guardians and Wards Act, 1890 faces the same limits under sections 29 and 31.
