That the Objector is not a party to the decree under execution, and has come to know that the property described below has been attached in the above execution proceedings. 2. THE PROPERTY ATTACHED [property_attached] 3. THE OBJECTOR'S RIGHT, TITLE AND INTEREST [grounds_of_objection] 4. FILE IT BEFORE THE SALE

Order XXI Rule 58 allows a person whose property has been attached in execution of a decree AGAINST SOMEBODY ELSE to have their claim adjudicated by the executing court itself.

But the rule is explicit that a claim shall NOT be entertained where the property has ALREADY BEEN SOLD in execution before the claim is made, or where the court considers the claim was designedly or unnecessarily delayed. Once the sale happens, this remedy is gone and what remains is a separate suit, which is slower, costlier, and against a purchaser who may have bought in good faith.

So the moment you learn of an attachment, act. Do not wait to see what happens. Paragraph 8 says the objection is filed promptly. If some time has passed since you learnt of the attachment, rewrite that paragraph to give the date you learnt of it and the reason for the gap, rather than leaving a statement you cannot support.

THE ADJUDICATION IS FINAL, NOT PRELIMINARY. An order determining a claim under Rule 58 has the force of a decree and is appealable. It is not a summary formality, so bring your documents, because you may not get a second opportunity to prove the same point.

WHERE THE DISPUTE IS ABOUT POSSESSION rather than attachment, for instance where you are being dispossessed under a decree to which you were not a party, Rules 97 to 101 govern instead, and the executing court determines all questions of right, title and interest arising between the parties, again with the force of a decree.

FILE WITH AN AFFIDAVIT supporting the facts in the petition, and fill in the verification by paragraph numbers: those true to your own knowledge in the first blank, and those based on information or documents in the second.

BRING: your title deed, tax receipts in your name, the encumbrance certificate, utility bills showing your possession, and anything showing the date you acquired the property relative to the decree. An acquisition AFTER the attachment is much harder to sustain.

అభ్యంతరాల పిటిషన్: ఇది ఏమిటి

An Objection Petition under Order XXI Rule 58 of the Code of Civil Procedure is filed by a person whose property has been attached in execution of a decree passed against someone else. It asks the executing court to decide the objector's claim, release the property from attachment and stop the sale. The objection must be raised before the property is sold.

మీకు ఈ పత్రం అవసరమైనప్పుడు

  • Your house, land or vehicle has been attached because a creditor obtained a decree against a relative, former owner or business partner.
  • You bought property before the decree or attachment and the decree holder now treats it as the judgment debtor's asset.
  • Your share in jointly held property has been attached for a debt owed only by the other co-owner.
  • You are about to be dispossessed under a decree to which you were not a party, which is dealt with under Rules 97 to 101 instead.

ఇది ఏమి కవర్ చేస్తుంది

  • The executing court, the execution case number and the names of the decree holder and judgment debtor.
  • The objector's name and address, and a statement that the objector is not a party to the decree.
  • A description of the property attached.
  • The objector's right, title and interest, a statement that the property does not belong to the judgment debtor, and that the objector holds possession in their own right.
  • A list of documents relied on and a statement that the objection is filed promptly and before any sale.
  • A prayer to adjudicate the claim, release the property, stay the sale and pass other just orders, signed through an advocate.

దాన్ని ఎలా పూరించాలి, సంతకం చేయాలి మరియు ఉపయోగించాలి

  1. Obtain the attachment order and the execution case details from the executing court as soon as you learn of the attachment.
  2. Gather title documents, tax receipts, utility bills and anything showing when you acquired the property compared with the decree and attachment.
  3. Fill in the details and set out your right, title and interest clearly, with dates.
  4. Have an advocate review and file it, because the court's decision under Rule 58 has the force of a decree and you may not get another chance to prove ownership, and because a claim filed after sale cannot be entertained.
  5. File the petition with a supporting affidavit and ask for an immediate stay of the sale.
  6. Lead your evidence at the inquiry, produce the original documents, and keep certified copies of the final order, which can be appealed.

జతచేయవలసిన లేదా దానితో ఉంచవలసిన పత్రాలు

  • Title deed, sale deed, gift deed or other proof of ownership.
  • Property tax and utility bills in the objector's name.
  • Encumbrance certificate for the property.
  • Revenue or mutation records showing possession.
  • Copy of the attachment order or proclamation of sale.
  • Affidavit supporting the petition.

దీని వెనుక ఉన్న చట్టం

Order XXI Rule 58 of the Code of Civil Procedure, 1908 lets a person claim, or object to the attachment of, property attached in execution, and requires the executing court to decide all questions of right, title and interest in that proceeding. The rule bars a claim made after the property has already been sold, or one the court finds was designedly or unnecessarily delayed. The decision has the force of a decree and is appealable. Where the dispute is about being dispossessed or resisting delivery of possession, Rules 97 to 101 apply and the executing court decides the questions in the same way.

నివారించడానికి సాధారణ తప్పులు

  • Waiting to see what happens and filing after the auction, when the Rule 58 remedy is no longer available.
  • Relying on oral claims or unregistered papers when the dispute concerns immovable property that needed a registered document.
  • Acquiring the property after the attachment, which is far harder to defend.
  • Treating the inquiry as a formality and not producing originals and witnesses, though the finding is final.

అభ్యంతరాల పిటిషన్: తరచుగా అడిగే ప్రశ్నలు

Can my property be attached for someone else's debt?

A decree can only be executed against the judgment debtor's own property. If your property is attached by mistake or because the decree holder believes it belongs to the debtor, you can object under Order XXI Rule 58 and the executing court will decide who owns it.

Is there a time limit to file an objection under Order 21 Rule 58?

The rule does not give a fixed number of days, but the claim cannot be entertained once the property has been sold, and the court can refuse a claim it finds deliberately or unnecessarily delayed. File as soon as you learn of the attachment.

What if the objection is rejected?

An order deciding a claim under Rule 58 has the same force as a decree, so it can be challenged in appeal like a decree. Check the limitation period for the appeal immediately after the order and apply for a certified copy without delay.

What is the difference between Rule 58 and Rules 97 to 101 of Order 21?

Rule 58 deals with objections to attachment of property. Rules 97 to 101 deal with resistance or obstruction to delivery of possession, and with a person other than the judgment debtor who has been dispossessed under the decree. Both require the executing court itself to decide the rights involved.

Is there any remedy if the property was sold before I objected?

Not under Rule 58 itself. The executing court cannot entertain a Rule 58 claim once the attached property has been sold, or where it finds the claim was designedly or unnecessarily delayed. Under Order XXI Rule 58(5) of the Code of Civil Procedure, 1908, a person whose claim is refused on either ground may file a suit to establish the right claimed in the property. Subject to the result of that suit, the order refusing to entertain the claim is conclusive.

Can the sale be stopped while my objection is pending?

The court can do so. Under Order XXI Rule 59 of the Code of Civil Procedure, 1908, where the property had already been advertised for sale when the objection was made, the court may postpone the sale of movable property until the objection is decided. For immovable property, it may order that the property shall not be sold, or that it may be sold but the sale shall not be confirmed, until the objection is decided. The order can be made on conditions as to security or otherwise.

Does the same procedure apply to property attached before judgment?

Yes. Order XXXVIII Rule 8 of the Code of Civil Procedure, 1908 provides that a claim to property attached before judgment is decided in the manner provided for claims to property attached in execution of a decree for the payment of money. That is the Order XXI Rule 58 procedure, so the same petition format can be adapted for an attachment before judgment.
