Depending on the circumstances, it is governed by the Juvenile Justice (Care and Protection of Children) Act, 2015 read with the Adoption Regulations made by the Central Adoption Resource Authority (CARA), or by the Hindu Adoptions and Maintenance Act, 1956. Adoption of an orphan, abandoned or surrendered child must proceed through the statutory process involving the Child Welfare Committee, a Specialised Adoption Agency and CARA. A private arrangement outside that framework is not merely irregular — it can attract criminal liability. This affidavit records consent; it does not itself effect an adoption, and it does not substitute for the statutory process or for the order of the competent court or authority.
